Policy for Changes and Cancellations

ALL NOTICES OF CANCELLATIONS AND REQUESTS FOR CHANGES TO ACCOMMODATIONS SHOULD BE SUBMITTED IN WRITING. ALL REFUNDS AND CHARGES ARE CALCULATED FROM THE DATE THAT NOTIFICATION WAS RECEIVED. A CANCELLATION IS DEFINED AS A SITUATION IN WHICH THE STUDENT/CLIENT DECIDES NOT TO USE THE ACCOMMODATION PROVIDED BY SARA'S HOMESTAY. A CHANGE IS DEFINED AS A SITUATION IN WHICH THE STUDENT/CLIENT DECIDES TO SWITCH FROM ONE ACCOMMODATION PROVIDED BY SARA'S HOMESTAY TO ANOTHER ACCOMMODATION PROVIDED BY SARA'S HOMESTAY OR IF THE STUDENT/CLIENT DECIDES TO SHORTEN THEIR STAY.

I. Cancellations for Homestay (excluding high school program - See section II)

• A. The $250 placement fee is non-refundable once a host has been accepted by the student / client.
• B. Cancellation request received at least two (2) weeks prior to arrival date: A full refund of payment received will be made within 30 days of written notification less the $250 placement fee.
• C. Cancellation request received less than two (2) weeks prior to arrival date: A cancellation fee of $350 will be charged. A refund of payment received will be made within 30 days of written notification, less the $250 placement fee and $350 cancellation fee.
• D. Cancellation request received after arrival date or students who fail to show up at the accommodation on scheduled arrival date (No Show): A cancellation fee of $350 will be charged . We require a two (2) week's notice for all cancellation. A refund of payment received will be made within 30 days of written notification less two weeks accommodation fees and the $350 cancellation fee and $250 placement fee. During the two (2) week notice period, the student is welcome to stay at the homestay. However, regardless if the student stays at the homestay, he / she will be charged the full two weeks.

II. Cancellations or Expulsions from High School Program

• A. The $1,000 deposit paid at the time of the reservation is non-refundable once a host whom meets Sara's Homestay standards is presented to the student / client.
• B. Cancellation request received prior to Sara's Homestay offering a host whom meets their standards: A cancellation fee of $500 will be charged. A refund of payment received, will be made within 30 days of written notification, less the $500 cancellation fee.
• C. No refund shall be given for cancellation requests received after a host has been accepted by the student / client; or students who fail to show up at the accommodation on scheduled arrival date (No Show); or in the event a student chooses to leave a homestay early without a valid reason or concern.
• D. In the event a student is expelled from her/his school (that does not involve breaking any state or federal laws, and it has been determined the student is not a danger to his/herself or others) that student will be offered at least one other school option from Sara's Homestay to be transferred too. If this option is not accepted within 24 hours, then the student will be expelled from the High School Program as well and will have to leave his host homes provided by Sara's Homestay within 48 hours. In the event of such expulsion, no refund shall be given.

III. Cancellations for Student Residences

Each residence has different cancellation policies. Please ask a Sara's Homestay representative prior to confirming the placement.

IV. Cancellations for Private Executive Apartments

Once an Executive Apartment has been booked and a lease has been signed, there are no cancellations allowed.

V. Changes for Homestay

After arrival, we will allow accommodation changes at no charge provided two (2) week's notice is given. Two weeks of accommodation fees will be charged from the date the request was received for any request for changes that needs to occur in less than 15 days.

As a result, we recommend that you review this Privacy Policy from time to time to ensure you are aware of the latest Privacy Policy terms and conditions.

This statement describes the information gathering process and the privacy and dissemination practices for the website located at the domain www.sarahomestay.com and the subdomains thereof (individually and collectively, the "Website") and the related services (the "Services") provided by and/or on behalf of Sara's New York Homestay LLC ("Sara's Homestay").

Sara's Homestay, either directly or indirectly, collects credit card numbers, addresses, bank information, and other personal information from people who choose to provide such information to Sara's Homestay.

Sara's Homestay's registration form requires users to provide contact information (including, but not limited to, name, address, and email), and demographic information (including, but not limited to, zip code, age, and income level). The Website may contain links to other web sites and Sara's Homestay is not responsible for the privacy practices or the content of such sites.

Sara's Homestay collects information about your transactions with Sara's Homestay. Sara's Homestay may receive and records information from your computer and browser, including your IP address, cookie information, and the page you request.

Sara's Homestay uses information for the following general purposes: to fulfill your requests for products and services, improve services provided by Sara's Homestay, contact you, conduct research, to deliver marketing and/or advertising materials to you relating to service(s) and/or product(s) provided by Sara's Homestay or other third parties, and to provide anonymous reporting for internal and external clients.

Additionally, Sara's Homestay, in its sole discretion, may disclose your personal information in connection with any of the following:

• To respond to subpoenas, court orders, or legal process, or to establish or exercise legal rights or defend against legal claims.

Sara's Homestay may use your email or street address to send you news or information regarding the Website and/or Services. Email and street addresses may also be used in private correspondence with you. Financial information that is collected is used to bill you for services. Sara's Homestay utilizes a third party service provider for credit card processing to facilitate your transactions.

Sara's Homestay uses certain commercially available programs to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while Sara's Homestay strives to use commercially acceptable means to protect your personal information, Sara's Homestay cannot guarantee its absolute security.

Sara's Homestay reserves the right to disclose your personally identifiable information as required by law and when Sara's Homestay believes, in its sole discretion, that disclosure is necessary to protect Sara's Homestay's rights and/or comply with a judicial proceeding, court order, or legal process.

Indemnity by Member

You will defend, indemnify, and hold harmless Sara's Homestay, its officers, directors, employees, agents, representatives and third parties ("Sara's Homestay Indemnitees"), from and against all claims, damages, losses, litigation expenses, counsel fees, and all other costs that may be asserted or claimed against the Sara's Homestay Indemnitees, or incurred by Sara's Homestay Indemnitees, that: (a) arise from, or are attributable to, any act or omission by you or your agents or representatives; (b) result from any breach of this Agreement by you; or (c) involve an allegation of infringement of any patent, trademark, copyright, or other intellectual property right or trade secret of a third party as well as any allegation of libel, slander, invasion of privacy, failure to obtain a necessary release, permission or clearance, or any other cause of action or claim arising out, directly or indirectly, your acts or omissions.

Online Content

Opinions, advice, statements, offers, or other information or content made available through the Website and/or the Services are those of their respective authors and not of Sara's Homestay, and should not necessarily be relied upon. Such authors are solely responsible for such content. Sara's Homestay does not guarantee the accuracy, completeness, or usefulness of any information located on or provided through the Website and/or the Services and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made. If Sara's Homestay has any claim or notice to provide to you in connection with this Agreement or in connection with the Website and/or any Services, Sara's Homestay may deliver such claim or notice to you via electronic mail, postal delivery or personal delivery, using the contact information you provided to Sara's Homestay, as such information may be updated by you from time to time. Such claim or notice will be deemed delivered the same day if sent by electronic mail or personal delivery, or five (5) days after being sent if sent by postal delivery. Sara's Homestay may terminate your membership or right to access the Website and/or the Services at any time, for any or no reason, with or without notice. Sara's Homestay reserves the right to immediately suspend or terminate your access to the Website and/or the Services, without notice, upon any breach of this Agreement by you. Your right to access the Website and/or the Services is for your sole, personal use. You may not authorize others to use the Services on your behalf, and you may not assign or otherwise transfer your right to access the Website and/or the Services to any other person or entity. By using the Website and/or Services, you represent and warrant to us that you have never been convicted of any felony and are not required to register as a sex offender with any governmental entity. You acknowledge that while Sara's Homestay does not conduct criminal or sexual offender background checks on its customers/residents, it reserves the right to do so.

SARA'S HOMESTAY DOES NOT NECESSARILY VERIFY THE TRUTHFULNESS, ACCURACY OR COMPLETENESS OF THE REPRESENTATIONS, WARRANTIES OR STATEMENTS MADE BY ITS CUSTOMERS/RESIDENTS. AS SUCH, THE RESULTS OF ANY REVIEW BY SARA'S HOMESTAY OF THE BACKGROUND OF ANY CUSTOMER/RESIDENT ARE FURTHER LIMITED BY THE FAILURE OF AN CUSTOMER/RESIDENT TO BE TRUTHFUL, ACCURATE OR COMPLETE IN PROVIDING INFORMATION TO SARA'S HOMESTAY. You agree that:

• You are solely responsible for the content or information you provide through the Website or through the Services.
• You will not provide information to Sara's Homestay any inaccurate material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity).
• You will only use the Website and Services in a manner consistent with any and all applicable laws, rules and regulations.
• You will not engage in advertising to, or solicitation of, other customers/residents of the Service to obtain, provide, buy or sell any products or services.
• You are solely responsible for your interactions with other customers/residents of the Service.

SARA'S HOMESTAY PROVIDES THE WEBSITE AND THE SERVICES ON AN "AS IS, WHERE IS" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, IN CONNECTION WITH THE WEBSITE, SERVICES ANY COMMUNICATION WITH SARA'S HOMESTAY OR ITS REPRESENTATIVES, OR OTHERWISE WITH RESPECT TO THE WEBSITE AND/OR THE SERVICES. SARA'S HOMESTAY SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Limitation of Liability

In no event will Sara's Homestay be liable to you for any incidental, consequential, special, punitive, exemplary, or indirect damages (including, but not limited to, damages for loss of data, loss of programs, lost profits, cost of procurement of substitute services or service interruptions) arising out of the use of or inability to use the Website and/or the Services, even if Sara's Homestay or its agents or representatives know or have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Sara's Homestay's. liability to you for any cause or action, damages, expenses or costs (collectively, "Claims"), whatsoever, regardless of the form or nature of the Claims, will at all times be limited to the amount of fees paid by you in the three (3) month period immediately preceding the events giving rise to such Claim(s). State by State Variations

Certain jurisdictions limit the applicability of warranty disclaimers and limitations of liability. General Provisions

You agree that New York law (regardless of conflicts of law principles) shall govern this Agreement, that any dispute arising out of or relating to this Agreement shall be subject to the exclusive venue of the federal and state courts in the State of New York, New York County, and that you submit to the exclusive jurisdiction of such courts in connection with any dispute related to the Website, the Services, or otherwise under the terms of this Agreement. This Agreement contains the entire agreement between you and Sara's Homestay regarding the use of the Website and the Services. Your obligations under this Agreement shall survive your ceasing to use the Website and/or Services. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, the remainder of this Agreement shall nevertheless continue to be in full force and effect.

Payment Terms: Cancellation and Refund Policy

You agree that with respect to any amounts you pay to Sara's Homestay, your right to receive a full, partial, or any refund of or credit for any amounts you pay to Sara's Homestay is subject to such cancellation and refund policy. Such cancellation and refund policy is subject to change at any time, without notice.

Copyright Policy

Termination of User Privileges for Infringement and Contact Information for Suspected Copyright Infringement: Sara's Homestay reserves the right to terminate your right to access the Website and/or the Services if you unlawfully transmit copyrighted material without a license, express consent, valid defense or fair use exemption to do so. In particular, if you submit content to or through the Website and/or the Services, whether articles, images, stories, software or other copyrightable material, you must ensure that the content you upload does not infringe the copyrights or other rights of third parties (such as privacy or publicity rights). After proper notification by the copyright holder or it agent to Sara's Homestay, and confirmation through court order or admission by you that you have used the Website and/or the Services as an instrument of unlawful infringement, Sara's Homestay may terminate your right to use and/or access the Website and/or the Services. Sara's Homestay may also in its sole discretion decide to terminate your right to use or access to the Website and/or the Services prior to that time if Sara's Homestay determines, in its discretion, that the alleged infringement has occurred.
